Terms of Service

1. The agreement
These Terms are a contract between you and Jobliy Technologies Inc. ("Jobliy", "we", "us"), a corporation with its head office at 840 Queens Plate Drive, Toronto, Ontario M9W 0E7, Canada. They apply whether you use the Jobliy website or the iOS or Android applications.
Creating an account or using Jobliy means you accept these Terms. If you are using Jobliy on behalf of a company, you confirm that you are authorised to bind that company, and "you" means both you and that company.
The Privacy Policy forms part of this agreement.
2. Who may use Jobliy
You need an account, a valid email address, and accurate information. One person, one account. You are responsible for everything done under your account and for keeping your password to yourself.
You must be at least 16 years old.
Jobliy is offered in Canada only. We do not offer the service to users outside Canada.
3. What Jobliy is, and what it is not
Jobliy is a marketplace that connects people looking for work with companies that are hiring. We provide the venue, the matching and the tooling.
We are not your employer, and we are not a party to any employment relationship formed through Jobliy. We do not make hiring decisions: every decision to advance, interview, make an offer or reject a candidate is made by the employer. We do not guarantee that a candidate will find work, that an employer will find a hire, or that any listing, profile or statement made by another user is true.
Employers and candidates deal with each other directly. Any offer, contract, wage or working condition is between them.
4. If you are looking for work
You control your profile. What you publish — your history, your documents, your answers — is what employers see, and you can remove it.
When you apply, the employer receives your profile, your documents and your answers. They keep their own record of that application. Deleting your Jobliy account does not reach into an employer's own systems, and cannot.
Be truthful. Misrepresenting your identity, your work history or your credentials is grounds for removal from Jobliy.
An employer may add you to Jobliy from a source outside it. Such a record is inert until you claim it, claiming it is your choice, and you may require its deletion at any time. See Privacy Policy section 3.3.
5. If you are hiring
Everything you post must be lawful, accurate, and for a real, currently available position.
You are responsible for your own compliance, and the product will hold you to parts of it:
- **Ontario (*Employment Standards Act*, s. 8.4–8.6). Postings must disclose expected compensation, whether artificial intelligence is used to screen or select applicants, and whether Canadian experience is required. Jobliy will not let you publish or edit a posting until these are answered, including postings created before the rule existed. You must also retain the posting and the application forms for three years after the posting comes down; that duty is yours. - Quebec (*Charter of the French language*). Postings shown to Quebec users need a French version. Jobliy records both versions on the same posting so that the pairing cannot come apart. - Human rights law. No posting may discriminate on a protected ground, and no screening question may solicit one. This is yours to get right; we remove postings that do. - Anti-spam (CASL).** Messages you send through Jobliy to candidates are subject to CASL. Do not use Jobliy to send commercial email to people who have not consented to receive it.
Candidate information you receive through Jobliy is for evaluating that candidate for that role. You may not export it into an unrelated database, sell it, or reuse it for a different purpose, and you must handle it in accordance with applicable privacy law — for that information, you are the one accountable.
Your team members act for you. Their conduct is your responsibility.
6. Acceptable use
Do not: post false or misleading information; impersonate anyone; harass, threaten or discriminate against another user; scrape, crawl or bulk-extract data; attempt to bypass access controls, rate limits or paywalls; upload malware; use Jobliy to advertise anything other than genuine employment; or charge a candidate a fee for a job.
We may suspend or remove an account that does these things. Where the conduct is serious we will act first and explain afterwards; otherwise we will usually ask first.
7. AI features
Some features use artificial intelligence to parse a résumé, suggest improvements, draft an application pitch, or explain why a job matched. They are optional, each one is invoked by you, and they are off until you separately agree to them. If you do not, the rest of Jobliy works normally.
Text you submit to an AI feature is sent to our AI provider outside Canada; see Privacy Policy sections 5 and 6. AI output is a suggestion. It is not advice, it is not a guarantee, and it can be wrong. Read what it produces before you send it to anyone — once you submit it, it is your statement, not ours.
We do not use AI to decide whether you get a job. Ranking affects the order in which things are shown; it does not accept or reject anyone.
8. Price
Jobliy is currently provided free of charge. No paid plan, subscription or credit is sold today.
If we introduce paid features we will publish their prices and the terms that govern them — including the billing period, renewal, refunds, taxes and what happens to anything unused — and we will obtain your agreement to those terms before charging you. Nothing in these Terms authorises us to charge you for anything.
9. Your content
You keep ownership of what you upload: your profile, your documents, your postings. You grant us the permission we need to run the service — to store it, show it to the users it is meant for, and process it for the features you use. That permission ends when you delete the content, except where we must keep a record by law (Privacy Policy section 7).
Jobliy itself — the software, the design, the name — is ours.
10. Ending the agreement
You may close your account at any time; deletion is self-service. We may suspend or close an account for a breach of these Terms, and we will tell you why unless doing so would compromise a safety investigation.
Some things survive the end of the agreement: anything you owe us, the disclaimers in section 11, and any record we must keep by law.
11. Disclaimers and liability
Jobliy is provided "as is". We do not warrant that it will be uninterrupted or error-free, or that it will produce a job or a hire.
We are not liable for the conduct of any user, for the truth of anything a user posts, for any employment relationship formed through Jobliy, or for a decision an employer makes.
To the extent the law permits, our total liability to you for any claim arising out of or relating to Jobliy is limited to the greater of the amounts you paid us in the twelve months before the claim and CAD $100.
Two limits on that paragraph, stated rather than hidden:
- It does not apply to gross negligence or wilful misconduct, which cannot be limited by contract. - Quebec's *Consumer Protection Act* prohibits clauses excluding or limiting liability toward a consumer. If you are a consumer in Quebec, that prohibition prevails over this section.
12. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, and the courts of Ontario have jurisdiction.
This does not take away a right you have where you live. If you are a consumer, nothing here prevents you from bringing proceedings in the courts of your own province, or from relying on the consumer protection law of your province. There is no arbitration clause in this agreement and no waiver of class proceedings.
13. Changes to these Terms
We may change these Terms. For a material change we will give notice and record your acceptance against the new version, so that an acceptance always points at the exact text accepted.
If you do not accept a change, you may close your account.
Where you hold a consumer contract governed by Quebec's *Consumer Protection Act*, we will not amend it unilaterally, and any change to it will be made only as that Act permits.
